The marriage petition A‑209 of 2023 is transferred from the Family Court, Solapur to the Family Court, Pune as the wife’s convenience justifies the transfer under Section 24 CPC.

Summary

The wife (applicant) residing in Pune filed a Miscellaneous Civil Application under Section 24 of the Code of Civil Procedure seeking transfer of the marriage petition (A‑209 of 2023) from the Family Court in Solapur to the Family Court in Pune. She argued that traveling 300 km to Solapur would disrupt her employment and that she already has domestic‑violence proceedings pending in Pune. The husband (respondent) contended that his senior‑citizen parents live in Solapur, making it inconvenient for them to attend proceedings in Pune. The Court, relying on the principle from N.C.V. Aishwarya v. A.S. Saravana Karthik that the wife’s convenience is paramount in matrimonial matters, held that the applicant’s inconvenience outweighed the respondent’s. Accordingly, the application was allowed and the marriage petition was transferred to the Pune Family Court, with the application thereafter disposed.

Issues considered

  • The appropriateness of transferring a matrimonial petition under Section 24 of the CPC.
  • Whether the wife’s convenience outweighs the husband’s and his parents’ inconvenience in deciding the transfer.
  • Impact of parallel domestic‑violence proceedings on the transfer decision.

A-209 of 2023. The proceedings filed by the Applicant under the

Protection of Women from Domestic Violence Act, 2005, in which the

Respondent and his family members are parties, are pending before the

Judicial Magistrate First Class at Pune.

7. In the case of N.C.V. Aishwarya vs. A.S. Saravana Karthik Sha1 in

paragraph No. 9, it has been observed as under:-

“9. The cardinal principle for exercise of power under
Section 24 of the Code of Civil Procedure is that the ends of
justice should demand the transfer of the suit, appeal or other
proceeding. In matrimonial matters, wherever Courts are called
upon to consider the plea of transfer, the Courts have to take
into consideration the economic soundness of both the parties,
the social strata of the spouses and their behavioural pattern,
their standard of life prior to the marriage and subsequent
thereto and the circumstances of both the parties in eking out
their livelihood and under whose protective umbrella they are
seeking their sustenance to life. Given the prevailing socio-
economic paradigm in the Indian society, generally, it is the
wife’s convenience which must be looked at while considering
            transfer.

8. Considering the statements made by the Applicant in this

Application and the submission of Mr. Sachin Hande, learned Advocate

for the Applicant, the inconvenience caused to the Applicant would be

greater than any inconvenience that may be caused to the Respondent.

Accordingly, this Application is allowed in terms of prayer clause (B).

Consequently, Marriage Petition No. A-209 of 2023 is withdrawn from

the Family Court, Solapur and transferred to the Family Court, Pune.
