The Court granted a two‑month extension for deposit of the amount, deeming it the petitioner’s last opportunity, and ordered execution of the sale deed within one month.

Summary

The petitioner, Venkatesh Prabhu Moni, sought a further two‑month extension to deposit Rs.4,52,80,208 with interest, after a prior three‑month extension had expired. The High Court noted that the respondent had not objected to the earlier extension and that this would be the petitioner’s last opportunity to comply. Counsel for respondents highlighted that the petitioner had also failed to execute a sale deed as previously directed. The petitioner’s counsel agreed to execute the sale deed within one month. Consequently, the Court granted the requested two‑month extension for deposit and ordered the sale deed to be executed within a month, disposing both miscellaneous civil applications.

                               DATED :- 28th April, 2026

           P.C.:

           1. By order dated 23rd December, 2025, this Court had extended the
time to deposit the amount of Rs.4,52,80,208/- for a period of three
months from the date of the order. The Respondent had not raised any
objection for the said extension at that time. It appears that the
extended time to deposit the said amount has also now expired and by

way of these applications, the Petitioner seeks further extension of two
months. to deposit the said amount.

                        2. For reasons mentioned in the applications, time to deposit the
balance amount of Rs. 4,52,80,208/- along with interest as per the
order dated 1st August, 2025, stands extended for a period of three
months from today. It is made clear that this is the last opportunity that
would be given to the Petitioner.

                        3. Mr Takkekar, learned Counsel appearing for Respondent Nos. 3 to
                        36, though, has not seriously objected to the extension of time;
however, he has brought to my notice that the Petitioner was put to
terms and was directed to execute the sale deed in his favour, which
the Petitioner has till date failed to do.

                        4. Mr. Tarun Rebello, learned Counsel appearing for the Petitioner
states, on instructions, that the Petitioner shall take steps to execute the
sale deed within a period of one month from today.

                        5. Both Misc. Civil Applications stand disposed accordingly.

                                                                     DR. NEELA GOKHALE, J.
