Holding

The High Court may correct clerical or typographical errors in its orders under its inherent jurisdiction, provided the correction does not alter the substantive rights of the parties.

Summary

The applicant, Kishori Santosh Kambale, filed a praecipe seeking correction of a typographical error in the order dated 4 September 2026 in Miscellaneous Civil Application No. 52 of 2026, where the district was incorrectly stated as Kolhapur instead of Pune. The applicant, through counsel Nisha Rajguru, pointed out the mistake in paragraph 7, line 1 of the order. The Court examined its inherent power to amend clerical errors in its own orders. It held that such corrections do not affect the substantive rights of the parties and may be made to ensure accuracy of the record. Accordingly, the Court ordered the substitution of "Pune" for "Kolhapur" in the specified paragraph and directed that the corrected order be uploaded on the Court's website. The praecipe was thereafter disposed.
