DOROTHY CONCEICAO GOLDFIELDversusGEORGE FRANCIS GOLDFIELD
- Decided

- DISPOSED OFF
Holding
The Court held that the petitioners are the sole legal heirs and are entitled to a Legal Heirship Certificate under Bombay Regulation VIII of 1827.
Summary
The petitioners, the widow, son and daughter of the deceased George Francis Goldfield, applied for a Legal Heirship Certificate under Section 2 of Bombay Regulation VIII of 1827. The deceased died intestate in Dubai on 4 May 2017 and the Municipal Corporation of Greater Bombay refused to issue a death registry certificate because the death occurred outside its limits, though it provided a cemetery disposal entry. The petitioners asserted that, under the Hindu Succession Act, 1956, they are the only legal heirs. The Court considered the delay in filing, condoning it by relying on the decision in Ganpati Vinayak Achwal, which holds that the right to apply for heirship is a continuous right. Finding the petitioners to be the sole heirs, the Court dispensed with the need for a proclamation and ordered the issuance of the Legal Heirship Certificate within four weeks.
Issues considered
- Whether a Legal Heirship Certificate can be issued under Bombay Regulation VIII of 1827 when the death occurred abroad and a death registry certificate is unavailable.
- Whether the delay in filing the petition is condonable.
- Whether the petitioners are the sole legal heirs under the Hindu Succession Act, 1956.
- Whether a proclamation is required before granting the heirship certificate.
