The court condoned the delay, affirmed that the petitioner, her son and daughter are the sole legal heirs, and ordered the issuance of the Legal Heirship Certificate without a proclamation.
Summary
The widow, Vasanti Shashikant Khicha, filed a petition under Section 2 of the Bombay Regulation Act VIII of 1827 seeking a Legal Heirship Certificate for her intestate husband, Shashikant Babulal Khicha, who died on 9 August 2021. The petitioner identified herself, her son Akansh and daughter Kriti as the only surviving legal heirs, and both children filed consent affidavits. The petition was filed after a delay, which the court condoned relying on the precedent set in Ganpati Vinayak Achwal 1 (2014 SCC OnLine Bom 1193) that the right to apply for heirship is a continuous right. The court held that the petitioner and her children are indeed the sole heirs and ordered the issuance of the Legal Heirship Certificate, dispensing with the need for a proclamation. The Department was directed to issue the certificate within four weeks.
Issues considered
- The applicability of condonation of delay in filing a petition for a Legal Heirship Certificate.
- Whether the petitioner, her son and daughter constitute the only legal heirs of the intestate deceased.
- Whether a proclamation can be dispensed with in granting a Legal Heirship Certificate.
