GANESH JIVANRAO SHINDEversusTHE STATE OF MAHARASHTRA AND ANOTHER

Disposal
DISPOSED OFF

Holding

The revision application is infructuous and must be disposed of because the trial against the deceased accused has been abated.

Summary

The applicant, Ganesh Jivanrao Shinde, filed a criminal revision application challenging a trial court order. During the pendency of the application, the co‑accused, Ganesh Shinde, died, leading the trial court to abate the proceedings against him on 22‑11‑2023. The trial court subsequently deleted the deceased accused from the charge sheet and proceeded only against Accused No. 1. The respondent counsel submitted the case status report confirming the death and abatement. The High Court observed that the death of the accused rendered the revision application moot. Consequently, the Court disposed of the revision application as infructuous.

                2. Learned Advocate for the Respondent No. 2 submitted

that during the pendency of this Application, as well as the trial, the
