The revision is allowed and the delay for filing the appeal is condoned.

Summary

The applicant, A. Mohammad Altaf, filed a criminal revision challenging the Sessions Court's rejection of his application for condoning delay in filing an appeal, asserting that he had deposited 20% of the cheque amount before the Sessions Court. The High Court examined whether the deposit justified condonation of the delay. Justice Shivkumar Dige allowed the revision, quashed the Sessions Court's order dated 29.04.2026, and condoned the delay. The Court ordered that the appeal be registered before the Sessions Court, which should decide the matter on its merits, and directed the applicant to file appropriate proceedings. The revision application was thereafter disposed of.

Issues considered

  • Whether the rejection of the delay condonation application by the Sessions Judge should be set aside given the applicant's deposit of 20% of the cheque amount.
  • Whether the delay in filing the appeal can be condoned under the circumstances.
