DEVISING S/O RAGHUNATH GIRASEversusTHE STATE OF MAHARASHTRA

Disposal
DISPOSED OFF

Holding

A revision application is infructuous and cannot be entertained if the accused has already undergone the entire sentence.

Summary

The petitioner, Devising, filed a criminal revision application (No. 267 of 2016) before the Bombay High Court, Aurangabad Bench, challenging a decision of the State. The respondent State, through counsel Mr. Aher, produced a letter from the Nashik Road Central Prison dated 12‑08‑2026 confirming that the accused had already served the entire sentence. The court noted that the prison authority’s communication was on record and marked as annexure ‘X’. Relying on this evidence, the court held that there was no longer any live controversy to be adjudicated. Consequently, the revision application was deemed infructuous. The matter was therefore disposed of without further hearing.
