The revision is dismissed as infructuous, and the lower court is directed to decide the pending RCC case within nine months.
Summary
Pandurang Narayanrao Byale filed Criminal Revision Application No. 32 of 2020 seeking relief against the State of Maharashtra. The applicant informed the court that the revision had become infructuous because the related Regular Criminal Court (RCC) No.9/2014 case pending before the Judicial Magistrate First Class, Loha, had been ongoing since 2014. He requested that the trial be expedited. The Court held that, given the applicant's own admission, the revision was indeed infructuous and therefore disposed of it. However, exercising its case‑management powers, the Court directed the learned JMFC, Loha, to dispose of the pending RCC case within nine months from the date of the order. The order thus both dismissed the revision and imposed a time‑bound directive on the lower court.
Issues considered
- Whether the Criminal Revision Application is infructuous and should be dismissed.
- Whether the High Court can direct the lower court to dispose of a pending criminal trial within a specified period.

CORAM : SUSHIL M. GHODESWAR, J.
DATE : 25 August 2026
P. C. :-
1. Learned advocate for the applicant states that this
revision has become infructuous. However, he prays that since
RCC No.9/2014 is pending before the learned JMFC, Loha, since
2014, trial may be expedited.
2. In view of the above statement, the Criminal
Revision Application is disposed of as being infructuous.
3. As RCC No.9/2014 is pending since 2014 and the
evidence has commenced, it would be appropriate to direct the
learned JMFC, Loha, to decide the said RCC case within a period
of nine months from today.
