Bombay High Court

PRAMOD N. RASALversusTHE STATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The revision application was dismissed as infructuous because the applicant had already been acquitted.

Summary

The applicant, Pramod N. Rasal, filed a criminal revision seeking discharge from the trial after an order refused to discharge him. While the revision was pending, the Special Court under the SEBI Act acquitted him on 29 January 2024, a judgment that was placed on record. The court noted that the acquittal rendered the revision application moot. Consequently, the revision was deemed infructuous and was disposed of without further hearing. The decision underscores that a revision becomes untenable when the substantive matter has been finally resolved in the applicant's favor.
