The Court recalled the order dated 25 March 2026 and allowed the review petition because the petitioners were denied a fair opportunity to be heard.

Summary

In Review Petition No.60 of 2026 arising out of Writ Petition No.5990 of 2006, the respondents argued that the petitioners were unable to appear before the Court due to difficulties they faced. The Court noted that the earlier order dated 25 March 2026 had been passed without hearing the rival contentions of the parties on the merits. Considering the respondents' explanation of the impediment and the lack of a substantive hearing, the Court held that the earlier order was vitiated. Consequently, the review petition was allowed and the order of 25 March 2026 was recalled. The matter was directed to be placed before the appropriate Court for further orders and a final hearing. The decision restores the petitioners' right to be heard on the merits of the dispute.

                      P.C.:

                      1. The respondents in Writ Petition No. 5990 of 2006 filed the
present review petition mainly on the ground that the review
petitioners were prevented from appearing before this Court due
to the difficulty stated in the petition.

                      2. Considering the reasons stated by the respondents, and also
considering that this Court had not considered the rival
contentions of the parties on the merits of the matter, therefore, in
my opinion, the order dated 25 March 2026 deserves to be
                      recalled.
