SHRIPATI RANGRAO BABURAO CHAVAN DECEASED LRSversusBABURAO RAMCHANDRA TORASKAR

Disposal
Disposed off as Withdrawn

Holding

The Court granted leave to withdraw the second appeal, disposing of it as withdrawn.

Summary

The appellants, Shripati Rangrao @ Baburao Chavan and others, filed a second appeal (No. 157 of 2026) seeking to set aside a judgment dated 06/11/2025 that confirmed a partition decree and to obtain a decree carving out their one‑quarter share of the suit land with an injunction against construction. During the hearing, the appellants' counsel, Mr. Amey V. Mahajan, requested leave to withdraw the appeal, a request that was not contested by the respondents' counsel, Ms. Siddheshwari R. Chavan. The Court, after noting the unopposed request, granted leave to withdraw the second appeal. Consequently, the second appeal was disposed of as withdrawn, and the accompanying interim application was also dismissed. No substantive merits of the original partition dispute were addressed, as the procedural withdrawal concluded the proceedings.
