Bombay High Court

DHANSHETTI RAJENDRA GOVINDRAO AND OTHERSversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court directed the respondents to decide the petitioners' pending representations on merit within eight weeks of receipt of the order.

Summary

Petitioners (Sudam Narayan Burkulee and others, Dhanshetti Rajendra Govindrao and others, and Shri Bhure Sangam Vishwanathrao and others) filed writ petitions under Article 226 of the Constitution seeking to be granted selection grade in their employment. Their applications for selection grade were pending with the Zilla Parishads of Nanded and Parbhani (respondents No. 5 and 6). The State of Maharashtra, through its Secretary, was also a respondent; the petitioners were represented by Advocate S.G. Munde, while the State and the Zilla Parishads were represented by various AGPs and counsel. The Court examined whether the authorities were obligated to decide the pending representations on merit within a reasonable time. It held that the respondents must decide the representations on their own merits and in accordance with law, and directed that the decision be rendered as expeditiously as possible, but in any event within eight weeks of receipt of the order. No specific statutory provision was invoked, and the writ petitions were disposed by the two‑judge bench of Justice Nitin B. Suryawanshi and Justice D. Shinde.
