SANTOSH RAMESH DESHMUKHversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The representation is to be treated as an appeal under the Government Resolution and must be decided within eight weeks.

Summary

Santosh Ramesh Deshmukh filed a writ petition challenging the order dated 23‑09‑2025 of the Grievance Redressal Committee of the Maharashtra State Board of Secondary and Higher Secondary Education, which had rejected his request. He subsequently made a representation on 29‑12‑2025 to the Divisional President of the Board, seeking relief. The High Court noted a Government Resolution dated 31‑07‑2026 directing that such representations be treated as appeals before the Committee headed by the Divisional President and decided within eight weeks. The Court held that the representation filed by the petitioner qualifies as an appeal under the said resolution and must be decided within the stipulated period, taking into account the precedent set in Writ Petition No. 5379 of 2019. Accordingly, the writ petition was disposed of, with the matter to be decided by the Board within eight weeks of receipt of the order.

Issues considered

  • Whether the representation dated 29‑12‑2025 can be deemed an appeal under the Government Resolution of 31‑07‑2026.
