Bombay High Court

SMITA SAHEBRAO SHINDEversusSTATE OF MAHARASHTRA THR THE SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that there was no cause of action as the petition was based only on apprehension, and therefore it could not be entertained.

Summary

Dr. Smita Sahebrao Shinde filed a writ petition challenging the interview conducted on 24 July 2026 for the post of Associate Professor in History, alleging that she was denied a presentation, the process was biased, and violated UGC regulations and government resolutions. She sought the interview record, a declaration of illegality, a fresh interview, and a restraining order against any appointment. The Court noted that no interview results or marks had been declared and that the petition was based solely on apprehension without any concrete injury. Finding no cause of action, the Court held that the petition could not be entertained. Consequently, the petition was disposed, with the Court leaving the matter open for future relief if a cause of action arises.
