Bombay High Court

MAHADEV CHANDRAM SHIVPUREversusTHE STATE OF MAHARASHTRA THR THE SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that the petitioner need not press the proposal for a Tribe Validity Certificate and ordered the respondent to process and release the retirement benefits.

Summary

Petitioner Mahadev Chandram Shivpure filed a writ petition seeking a mandamus directing the Zilla Parishad to release his retirement benefits, including gratuity and pension, which were withheld because he had not submitted a Tribe Validity Certificate. The Court noted earlier judgments (Shankar Shamanna Tangdelu, Ashok Kishanrao Ardade, and Harishchandra Ganpati Koli) that dealt with the same issue. Relying on those precedents, the Court ordered the petitioner to file an affidavit stating he will not press for a tribe‑validity certificate, and directed the respondent to process and release the pension benefits within eight weeks. The order effectively granted the relief sought, subject to the affidavit compliance. The petition was therefore disposed of with directions for compliance.

Issues considered

  • Whether the petitioner is entitled to retirement benefits despite the absence of a Tribe Validity Certificate.
  • Whether the High Court can issue a mandamus directing the release of such benefits.
  • Whether the petitioner must obtain a tribe‑validity certificate before the benefits can be released.
