Bombay High Court

RIYA RAJU KADAMversusTHE UNION OF INDIA MINISTRY OF EDUCATION AND OTHERS

Disposal
DISPOSED OFF

Holding

The court held that there is no sufficient ground for the respondent to withhold the petitioner’s NEET‑UG result and directed its declaration within four days.

Summary

The petitioner, Riya Raju Kadam, filed a writ petition challenging the respondents' refusal to declare her NEET-UG 2026 result, arguing that she was not named as an accused in the CBI charge sheet and had already appeared for the Re‑NEET‑UG examination. The court examined whether there was any legal basis for the respondents to withhold the result. Finding no sufficient ground, the bench directed the respondents to announce the petitioner’s result within four days and, if she is found eligible, to allow her to take part in the third round of counselling (CAP round 3). The order was issued by a two‑judge bench of the Bombay High Court. The petition was subsequently disposed of with the said directions.

Issues considered

  • Whether the respondent is justified in withholding the petitioner’s NEET‑UG 2026 result pending the CBI investigation.
  • Whether the petitioner is entitled to participate in the third round of NEET‑UG counselling if she is found eligible.

                 1. Having heard the learned Advocate for the Petitioner and

learned Advocates for the Respondents and in view of the fact

that the Petitioner is not arrayed as an accused in the charge
