Bombay High Court

KHATEEB SAYYEDA KHUTEJA BEGUM MASIHUDDINversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court directs the Education Officer to decide on the petitioner’s proposals on merits within eight weeks of receipt of the order.

Summary

The petitioner, Khateeb Sayyeda Khuteja Begum Masihuddin, filed a writ petition before the Bombay High Court seeking a direction to the Education Officer (Respondent No.3) to decide on her proposals dated 1 September 2024, 8 May 2025 and 19 June 2026. The respondents, the State of Maharashtra and others, had not taken a decision on those proposals. The Court examined whether a writ could compel the Education Officer to act and whether the petitioner was entitled to a time‑bound decision. Finding no sufficient justification for the delay and recognizing the petitioner’s right to have her proposals considered, the Court ordered the Education Officer to decide on the proposals on their merits. The order disposes the writ petition.
