Bombay High Court

KUSHAL SANJAY MOREYversusTHE STATE OF MAHARASHTRA THROUGH ITS CHIEF SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is disposed of, directing the State to decide the petitioner’s representation in line with government policy and the Shivanandan precedent.

Summary

The petitioner, Kushal Sanjay Morey, filed a writ petition seeking a three‑year scholarship instead of the usual two‑year term, citing a similar grant made to another student for postgraduate and Ph.D. studies abroad. The State of Maharashtra, represented by the Attorney General, submitted the petitioner's representation dated 21‑08‑2026. The Court, without delving into substantive merits, ordered the respondents to consider the representation in accordance with government policy and the precedent set by the Apex Court in Shivanandan C. T. & Others v. High Court of Kerala (W.P. (C) No. 229 of 2017). The judges directed that a decision be rendered within four weeks of the order. Consequently, the writ petition was disposed of, directing administrative compliance rather than granting immediate relief.

Issues considered

  • Whether the petitioner is entitled to a three‑year scholarship under the applicable government policy.
  • Whether the precedent set in Shivanandan C. T. & Others v. High Court of Kerala is applicable to the petitioner’s claim.
