RATNA KHUSHALRAO BHAVAREversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petitioner must first approach the Grievance Redressal Committee under the 2024 Government Resolution before seeking judicial relief.

Summary

The petitioner, Ratna Khushalrao Bhavare, filed a writ petition before the Bombay High Court, Aurangabad Bench, seeking relief against the State of Maharashtra and other respondents. The petition raised the question of whether the petitioner could directly approach the court for redress of her grievance. The Court examined the procedural framework established by the Government Resolution dated 27 March 2024, which created a Grievance Redressal Committee for such matters. It held that the petitioner must first exhaust the remedy provided by that Committee before the Court can entertain the grievance. Accordingly, the Court granted the petitioner liberty to approach the Committee within two weeks and disposed of the writ petition. The order directed that the Committee consider the grievance in accordance with government policy, rules and regulations and do so expeditiously.
