The Court held that the petitioners are entitled to the one‑step pay scale benefits and directed the respondents to verify records and grant the salary benefits accordingly.
Summary
The High Court of Bombay, Aurangabad Bench entertained writ petitions filed by employees seeking salary benefits under the one‑step pay scale applicable to staff posted in Tribal and PESA areas. The petitioners contended that, pursuant to the Government Resolution dated 29‑02‑2024, they were entitled to the revised pay scale, arrears and current salary, but the Directorate of Higher Education had not effected the same. The Court observed that the matter had already been decided in Writ Petition No. 248 of 2026 and Writ Petition No. 13241 of 2024, and that those rulings squarely covered the issues raised. Accordingly, the Court allowed the petitions, directing the Director and Joint Director of Higher Education to scrutinise the petitioners' records within 30 days, clear any cases without legal impediment, and pay the entitled benefits along with arrears. If any petitioner is found ineligible, the respondents must issue a notice, conduct a hearing within 120 days, and pass an appropriate order. Petitioners dissatisfied with an adverse order may avail themselves of the statutory remedies available under law.
Issues considered
- Whether employees posted in Tribal and PESA areas are entitled to salary benefits under the one‑step pay scale as per the Government Resolution dated 29‑02‑2024.
- Whether the Directorate of Higher Education is obligated to verify records and grant the said benefits without undue delay.
- What procedural safeguards are available to petitioners if an adverse order is issued after verification.
