The Court directed the respondents to independently scrutinise the petitioners' reimbursement proposals and, if found entitled, to pay the fees within four weeks.

Summary

The petitioners, two educational trusts, filed writ petitions seeking reimbursement of fees for the 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009. They alleged that the State of Maharashtra and other respondents were liable to refund the fees collected for those students. The High Court examined whether the petitioners were entitled to such reimbursement under the RTE Act. The Court held that the respondents must independently scrutinise the petitioners' proposals and decide on the reimbursement claim. Accordingly, the Court directed the respondents to complete the scrutiny within four weeks of receiving a copy of the order and, if the claim is found valid, to pay the reimbursement within a further four weeks. The petitions were disposed of with these directions.
