The Court directed the State to examine the fee‑reimbursement proposals of each petitioner and, if entitlement is established, to disburse the reimbursement within the stipulated time.
Summary
A batch of writ petitions filed by various educational societies sought a direction from the State of Maharashtra to reimburse fees paid for the 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The petitions were heard together and the Court noted that they fall under a prior order (Writ Petition No. 4127/2026) issued by a coordinate bench. The Court directed the State to independently scrutinise each petitioner’s proposal on its merits and to make a decision within four weeks of receiving the order. If any petitioner is found eligible for reimbursement, the Court ordered that the amount be disbursed within a further four weeks. The petitions were therefore disposed of without further hearing.
Issues considered
- Whether the State of Maharashtra is obligated to reimburse fees paid by educational societies for the 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009
- Whether the earlier order in Writ Petition No. 4127/2026 governs the present batch of petitions
