Holding

The Court directed the State to scrutinise the petitioners’ reimbursement proposals on merit and, if entitlement is established, to disburse the fees within the stipulated time‑frames.

Summary

The Bombay High Court, Aurangabad Bench, heard a series of writ petitions filed by various educational societies seeking reimbursement of fees for 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The petitioners asked the State of Maharashtra to direct the authorities to examine their reimbursement claims and, if justified, to disburse the amounts promptly. The Court noted that the matters were already covered by its earlier order dated 18 April 2026 in Writ Petition No. 4127/2026. Accordingly, the Court disposed of the present petitions, directing the State to independently scrutinise each petitioner’s proposal on its merits and to decide within four weeks of receiving the order, with any awarded reimbursement to be paid within a further four weeks. The decision rests on the statutory right to free education and the State’s duty to implement fee‑reimbursement provisions.

Issues considered

  • The State of Maharashtra is obligated under the Right of Children to Free and Compulsory Education Act, 2009 to reimburse fees for the 25% quota of students admitted by private educational societies.
  • Whether the petitioners are entitled to reimbursement of fees and, if so, the procedure and timeline for such reimbursement.
