The petitions are covered by the earlier order and the respondents must scrutinise the petitioners’ reimbursement proposals and disburse amounts if entitlement is established.
Summary
The petitioners, a group of educational societies, filed writ petitions seeking reimbursement of fees for the 25 % of students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The State of Maharashtra and other respondents were directed to consider the petitions. The Court noted that these petitions fall within the scope of an earlier order (Writ Petition No. 4127/2026) which had already addressed similar reimbursement claims. Accordingly, the Court ordered the respondents to independently scrutinise each petitioner’s proposal on its merits and to decide within four weeks of receiving the order. If any petitioner is found entitled, the reimbursement must be paid within an additional four‑week period. The petitions were therefore disposed of with the above directions.
Issues considered
- Whether the petitioners are entitled to reimbursement of fees for the 25 % of students admitted under the Right of Children to Free and Compulsory Education Act, 2009
- Whether the earlier order in Writ Petition No. 4127/2026 governs the present petitions
