VARAD INSTITUTE OF TECHNOLOGY AURANGABAD THR ITS PRESIDENT SANJAY A KULKARNIversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that the State must independently evaluate the fee‑reimbursement proposals of the petitioners under the RTE Act, decide within four weeks, and reimburse where entitlement is established.

Summary

The Bombay High Court, Aurangabad Bench, heard a series of writ petitions filed by various educational societies seeking reimbursement of fees paid for the 25 % of students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The petitioners contended that the State of Maharashtra was obligated to refund the fees once the students were admitted under the statutory reservation. The Court noted that the matters were already covered by its earlier order dated 18 April 2026 in Writ Petition No. 4127/2026, which directed the State to examine such reimbursement claims. Accordingly, the Court disposed of the present petitions, directing the respondents to independently scrutinise each petitioner’s proposal and to make a decision within four weeks of receipt of the order. If entitlement is established, the reimbursement must be disbursed within an additional four weeks.

Issues considered

  • Whether the State of Maharashtra is liable to reimburse fees for the 25 % of students admitted under the Right of Children to Free and Compulsory Education Act, 2009
  • Whether the petitioners are entitled to reimbursement without a separate hearing
  • Whether the earlier order in Writ Petition No. 4127/2026 governs the present petitions
