Holding
The Court held that the State must scrutinise the reimbursement claims of the petitioners and, if they are found entitled, must disburse the fees within the time‑frames specified.
Summary
A series of writ petitions filed by various educational societies sought reimbursement of fees for the 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The petitioners argued that the State of Maharashtra was obligated to refund the fees paid for these students. The Court noted that the matter had already been addressed in an earlier order (Writ Petition No. 4127/2026) which directed the State to scrutinise such reimbursement claims on their merits. Accordingly, the Court ordered the State to examine each petitioner's proposal independently and to decide within four weeks of receiving the order, and, if entitlement is established, to disburse the reimbursement within a further four weeks. The petitions were therefore disposed of with these directions.
Issues considered
- Whether the State of Maharashtra is liable to reimburse fees paid by educational societies for the 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009
- Whether the earlier order in Writ Petition No. 4127/2026 governs the present petitions
