The Court held that the State must scrutinise the petitioners' reimbursement proposals under the RTE Act and decide within four weeks, disbursing any amount due within a further four weeks.
Summary
The Bombay High Court, Aurangabad Bench, heard a series of writ petitions filed by various educational societies seeking reimbursement of fees for the 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The petitioners asked the State of Maharashtra to direct the authorities to examine their reimbursement proposals and, if found eligible, to disburse the amounts. The Court noted that the matters were already covered by its earlier order in Writ Petition No. 4127/2026, which directed a scrutiny of such proposals. Accordingly, the Court disposed of the present petitions, directing the State to independently scrutinise the proposals on their merits and to take a decision within four weeks of receiving the order, and to pay any awarded reimbursement within a further four weeks. The order thus provides a procedural timeline for fee‑reimbursement claims under the RTE Act.
Issues considered
- Whether the State of Maharashtra is obligated to reimburse fees for the 25% of students admitted under the Right of Children to Free and Compulsory Education Act, 2009.
- Whether the petitioners are entitled to a speedy decision and disbursement of any reimbursement.
