Holding
The petition is disposed of, directing that the petitioners may file a representation before the Deputy Conservator of Forests and that the Scrutiny Committee shall adjudicate the grievance expeditiously.
Summary
The petitioners challenged the mutation of their land into "Private Forest" by the Revenue and Forest Department, alleging that the procedure prescribed under Section 35 of the Indian Forest Act, 1927 was not followed. The High Court noted its earlier directions in Writ Petition No.1536 of 2017 and Writ Petition No.5344 of 2026, which dealt with similar grievances. It directed that the petitioners be allowed to file a representation before the Deputy Conservator of Forests, and that the matter be placed before the Scrutiny Committee established under the Government Resolution dated 13 August 2026. The Court emphasized that the Scrutiny Committee must adjudicate such matters expeditiously. Accordingly, the writ petition was disposed of, with the procedural remedy granted to the petitioners.
Issues considered
- Whether the mutation of land as "Private Forest" without compliance with Section 35 of the Indian Forest Act, 1927 is valid.
