MAHENDRASING PREMSING PATILversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petitioner must approach the Grievance Redressal Committee and the writ petition is disposed.

Summary

Mahendrasing Premsing Patil filed a writ petition challenging an order dated 23/07/2026 passed by Respondent No.3. The State, through its AGP, argued that the petitioner’s grievance should be addressed by the Grievance Redressal Committee constituted under the Government Resolution of 27/03/2024. The Court held that the petitioner must first approach that Committee, which will consider the grievance on its merits within 12 weeks of appearance. Accordingly, the Court directed the petitioner to file his grievance before the Committee and disposed of the writ petition. The decision emphasizes the procedural route provided by the government resolution for administrative grievances.

Issues considered

  • Whether the petitioner should be directed to approach the Grievance Redressal Committee under the Government Resolution dated 27/03/2024 for relief.
  • Whether the writ petition is maintainable in the absence of prior exhaustion of the grievance redressal mechanism.
