Holding

The petition is disposed with directions permitting the petitioners to file a representation before the Deputy Conservator of Forests and for the Scrutiny Committee to adjudicate the grievance expeditiously.

Summary

The petitioners challenged the mutation of their lands as ‘Private Forest’ alleging that the procedure under Section 35 of the Indian Forest Act, 1927 was not followed. The Court, recalling its earlier directions in Writ Petition No.1536 of 2017 and Writ Petition No.5344 of 2026, directed that the petitioners may file a representation before the Deputy Conservator of Forests. The representation is to be placed before the Scrutiny Committee, which must act in accordance with the Government Resolution dated 13 August 2026 and decide the grievance expeditiously. The Court ordered that all pleadings be adjudicated by the Scrutiny Committee without delay. Consequently, the writ petition was disposed of.

Issues considered

  • Whether the petitioners are entitled to file a representation before the Deputy Conservator of Forests for redressal of alleged wrongful mutation of land as ‘Private Forest’.
