VASANT HARISHCHANDRA PATIL THRU HIS LEGAL REPRESENTATIVEversusTHE STATE OF MAHARASHTRA THRU MINISTRY AND ORS

Decided

Holding

The Court disposed of the writ petition, granting four weeks to the revenue authority to decide the revision application and continuing the ad‑interim order to maintain the status‑quo.

Summary

The petitioners filed a writ petition challenging the non-consideration of their revision application dated 29 June 2026, which was pending before the Minister (Revenue) against an order dated 9 June 2026 passed by the Additional Divisional Commissioner, Konkan Division. Fearing that the jurisdictional Tahsildar might alter the revenue records during the pendency of the revision, the High Court earlier issued an ad‑interim order on 7 September 2026 to maintain the status‑quo. The respondents informed the Court that the revision would be heard and decided within four weeks by the Minister (Revenue). The petitioners sought continuation of the ad‑interim order until the revision is finally decided. The Court granted the four‑week period to the authority to dispose of the revision application, ordered that the ad‑interim order remain in force to protect the petitioners’ interest, and disposed of the writ petition.

Government of Maharashtra against the order dated 9th June, 2026 passed

by the learned Additional Divisional Commissioner, Konkan Division in

Revision Application No. Appeal/Desk/RTS/Rev./306/2025. Taking note

of the apprehension expressed by the Petitioners that during the

pendency of the Revision Application, the jurisdictional Tahsildar may

alter the Revenue records, this Court has passed an ad-interim order

dated 7th September, 2026 in terms of prayer clause (c) in the Writ

Petition, which is holding the field till today.

3. When the matter is called out today, Ms. Kavita Solunke, learned

Additional Government Pleader submits, on instructions, that within four

weeks from today the Revision Application filed by the Petitioners

would be heard and decided finally by the Hon’ble Minister (Revenue).

In that view of the matter, we do not find justifiable ground to keep this

Writ Petition pending before this Court any further.

4. At this stage, Mr. Kulkarni submits that until such time the

Revision Application is disposed of, interest of the Petitioner be

protected by continuing the ad-interim order dated 7th September, 2026.
