The Court directed the Divisional Joint Registrar, Co-operative Societies (Mumbai Division) to pass the pending orders within four weeks.

Summary

The petitioners filed a writ petition seeking a direction to the Divisional Joint Registrar of Co-operative Societies (Mumbai Division) to pass pending orders on Revision Application No.517 of 2025 and Appeal No.40 of 2026, which had remained undecided for over five months. The Court examined the petition and found the relief sought to be innocuous, noting that the proceedings were closed for orders but no orders had been issued. Consequently, the Court directed the Registrar to pass the final orders on both matters within four weeks from the date of the order. The Court also ordered the Government Advocate to communicate this direction to the Registrar. With these directions, the writ petition was disposed of.

                 P.C. :

                 1. The limited relief sought by the petitioners through this

petition is a direction to the Divisional Joint Registrar, Co-operative

Societies (Mumbai Division) i.e. respondent No.2, to pass orders on

Revision Application No.517 of 2025 and Appeal No.40 of 2026,

which have been heard by him, but orders thereon have not yet been

                 passed since February 2026.

 N. S. Chitnis 1/2
                                                                    913-wp.11186.2026.doc

                2. Upon hearing the counsel for the petitioners and on

perusal of the petition, we find that the relief sought is innocuous in

nature and it is evidently clear that the proceedings have been closed

for orders, but the same remain undecided for more than five months.

We, therefore, direct the Divisional Joint Registrar, Co-operative

Societies (Mumbai Division)/respondent No.2 to pass final orders,

adjudicating the Appeal as well as the Revision Application which have

been closed for orders, in any event, no later than four weeks from

                today.

With these directions, the writ petition stands disposed of.

The learned Government Advocate shall communicate the

aforesaid order to respondent No.2-Divisional Joint Registrar, Co-

                operative Societies (Mumbai Division).
