Pending the larger Bench decision, the petitioner may file a revision before the State to challenge the order condoning delay.

Summary

The petitioners Suresh Namdeo Waghere & Ors. challenged an order condoning delay issued by the respondents. The central question was whether an appeal before the Sub‑Divisional Officer or a revision before the State was the appropriate remedy. The learned Attorney General argued that a revision before the State was maintainable, relying on the Court’s earlier decision in Writ Petition No. 5716 of 2024. The petitioner’s counsel highlighted that the issue was still pending before a larger Bench in Writ Petition No. 2103 of 2021. In view of the earlier judgment and the pending larger Bench decision, the Court permitted the petitioner to file a revision petition before the Minister, directing that the concerned authority decide it according to law. Consequently, the petition was disposed with liberty to challenge the impugned order in revision.
