Bombay High Court

RAVINDRA SHAM RATHODversusTHE STATE OF MAHARASHTRA THR THE PRINCIPAL SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The writ petition is disposed because the petitioner has an alternate efficacious remedy before the Director of Marketing.

Summary

Shri Ravindra Sham Rathod filed a writ petition before the Bombay High Court, Aurangabad Bench, challenging an action of the State of Maharashtra. The petition raised several disputed questions of law and fact. The Court observed that the petitioner had an alternate and efficacious remedy by approaching the Director of Marketing, Maharashtra State. Consequently, the Court held that the writ petition was not the appropriate forum for immediate relief. The petition was therefore disposed, with liberty granted to the petitioner to file an application before the Director of Marketing within one week. The Court directed that the application, if filed, be decided expeditiously and, in any event, within three weeks of filing. No substantive merits of the underlying dispute were adjudicated.
