The petition is allowed; the impugned order quashing the petitioner’s gratuity and pension is set aside and the Zilla Parishad is directed to pay Rs.30,96,585 to the petitioner.

Summary

Subhash Mahadev Naik filed a writ petition seeking the release of his gratuity and pension from Sindhudurg Zilla Parishad, challenging an order dated 30‑06‑1999 that had quashed his retirement benefits. The Court examined the legality of that impugned order and the petitioner’s entitlement under Section 133 of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961, as well as the Maharashtra Zilla Parishad (Payment of contribution towards pension, gratuity and other benefits) Rule, 1971 and the Rights of Persons with Disabilities Act, 2016. The Zilla Parishad, through its CEO, calculated the amount due as Rs.30,96,585 and confirmed the availability of funds. The Court accepted the CEO’s undertaking and directed the Zilla Parishad to transfer the amount to the petitioner’s bank account within ten days. Accordingly, the writ petition was allowed and the order quashing the benefits was set aside.

  • Whether the petitioner is entitled to gratuity and pension under Section 133 of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961 and the applicable 1971 Rule?
