LAXIMAN KASHINATH SABLEversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is dismissed as it lacks substantive merit, having been adequately addressed by the administrative enquiry.

Summary

The petitioner, Laximan Kashinath Sable, filed a criminal writ petition seeking a direction to implement a communication dated 27 July 2021 issued by the Residential Deputy Collector, Ahmednagar, concerning a complaint of alleged breach of Covid Protocol by public representatives of Kopargaon Taluka. The petitioner alleged that the function in question violated Covid regulations. The respondent State, through the Additional Public Prosecutor, relied on a later communication dated 22 August 2022 stating that an enquiry had been conducted and found that the function was conducted with prior permission and in compliance with Covid Protocol rules. The High Court examined the communications and concluded that the petition lacked substantive merit. Consequently, the Court disposed of the petition, indicating that any further grievance must be pursued through appropriate legal proceedings. The decision underscores the Court's deference to administrative findings where due process has been observed.

Issues considered

  • Whether the petitioner is entitled to a direction to implement the communication dated 27 July 2021 concerning alleged breach of Covid Protocol
