AGRICULTURAL PRODUCE MARKET COMMITTEE HINGOLI THR ITS ADMINISTRATOR AND ANOTHERversusTHE DIVISIONAL JOINT REGISTRAR CO OPERATIVE SOCIETIES CHH SAMBHAJINAGAR AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court directed the Registrar (respondent No. 1) to decide the pending appeal within six weeks and disposed of the writ petition without issuing notice to respondent No. 3.

Summary

The Agricultural Produce Market Committee, Hingoli filed a writ petition challenging an order dated 20 May 2026 by the Divisional Joint Registrar, Co-operative Societies, which granted a stay on a suspension order the Committee had issued against respondent No. 3. The petitioners sought a direction for the Registrar (respondent No. 1) to decide the pending appeal within a fixed period, rather than a fresh notice to respondent No. 3. The Court considered the petitioners’ request and, finding the matter ripe for final adjudication, decided that issuing a notice was unnecessary. Accordingly, the Court directed the Registrar to dispose of the appeal within six weeks and dismissed the writ petition. The order effectively restores the status quo pending the Registrar’s decision.

Issues considered

  • Whether the High Court should issue notice to respondent No. 3 before directing the Registrar to decide the pending appeal.
  • Whether the petitioner's request for a time‑bound direction to the Registrar is appropriate in the circumstances.

Subjects

  • writ petition
  • stay order
  • suspension

             PER COURT :

                      Heard.

             2. The petitioners have challenged the order dated 20.05.2026 passed by
the Divisional Joint Registrar, Co-operative Societies, Chhatrapati
Sambhajinagar, in Appeal No. 4/2026. Though the challenge is to the order
granting stay to the order of suspension issued by the petitioner against
respondent no. 3, learned counsel for the petitioner, while making
submissions, would submit that although a prayer for setting aside the said
order of suspension has been made, considering that the matter is ripe for
final hearing before the Registrar, he would be satisfied if a direction is
issued to respondent no. 1 to decide the pending appeal within a stipulated
period. In view of the request made by learned counsel for the petitioner, in
my opinion, instead of issuing notice, it would be appropriate to direct
respondent no. 1 to decide the pending appeal finally. Hence, without
issuing notice to respondent no. 3, the following order is passed:

                                                                                             1/2
                                                       10 WP 11846 OF 2026.odt

                                         ORDER

A) Respondent no. 1 is requested to decide the appeal pending before
him as early as possible and in any event within a period of six weeks from
today.

B) Writ petition is disposed of.
