SHRI SAI EDUCATIONAL TRUST CHH SAMBHAJINAGAR THR ITS PRINCIPAL AGNEL S DCUNHAversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that the State must independently scrutinise the petitioners' proposals and, if they are found eligible, reimburse the fees within the stipulated time‑frame.

Summary

Several educational trusts filed writ petitions seeking reimbursement of fees paid for students admitted under the Right to Education Act. The petitions alleged that they were entitled to such reimbursement but the State had not processed their claims. The Court observed that the matter had already been decided in Writ Petition No. 6307 of 2026 and therefore ordered the State to independently scrutinise each petitioner’s proposal on its merits. The State was directed to make a decision within four weeks of receiving the order and, if eligibility is established, to disburse the reimbursement within a further four weeks. The petitions were consequently disposed.

Issues considered

  • Whether the educational trusts are eligible for reimbursement of fees under the Right to Education Act
  • Whether the State must undertake an independent scrutiny of the petitions’ proposals before granting reimbursement
