Bombay High Court

DR DADASAHEB HANUMATRAO DHAGEversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

All the writ petitions are disposed of as they are covered by the earlier judgment in Writ Petition No. 6549 of 2026, with interim relief vacated but extended for six weeks.

Summary

Several doctors filed writ petitions (Nos. 11919 of 2021, 2933, 3056, 3057 of 2019) challenging orders of the State of Maharashtra. The petitioners, through counsel M. P. Kale, sought to withdraw one petition and later argued that the remaining petitions were fully covered by a prior judgment of this Court in Writ Petition No. 6549 of 2026. The Court accepted the withdrawal, held that the earlier judgment subsumed the remaining petitions, and consequently disposed of all the writ petitions. The interim relief previously granted was vacated, but the Court allowed the continuation of that relief for an additional six‑week period. The orders were pronounced by Justices Kishore C. Sant and Jitendra Jain.

Issues considered

  • Whether the writ petitions filed by the doctors are covered by the earlier judgment in Writ Petition No. 6549 of 2026.
  • Whether the interim relief granted in the earlier proceedings should continue after the disposal of the petitions.
