Bombay High Court

SATISH WARIERversusTHE VILLAGE PANCHAYAT OF ASSAGAO THR ITS SECRETARY AND ANR

Disposal
Disposed of

Holding

The petition is disposed, and the Panchayat's revision must be decided on its merits independently of the earlier desealing order.

Summary

Satish Warier filed a writ petition challenging two orders of the Village Panchayat of Assagao. The Director of Panchayats had allowed the appeal for desealing Warier's premises, but the Panchayat's revision had dismissed his challenge to the rejection of his trade licence. The petitioner sought relief on both matters, arguing that the earlier desealing order should influence the revision. The Bombay High Court, after hearing counsel, disposed of the petition, directing that the Panchayat's revision be decided on its own merits without being affected by the prior desealing order. All contentions of the parties were kept open for determination in the pending revision proceeding.

Issues considered

  • Whether the High Court should set aside the Panchayat's revision order rejecting the trade licence.
  • Whether the earlier order of desealing the premises impacts the pending revision proceeding.

Subjects

  • Panchayat law

                             AMIT S. JAMSANDEKAR, JJ.
                     DATED :- 7th September, 2026

P.C.:

1. The learned Advocate for the Petitioner submits that the appeal
pending before the Director of Panchayats with regard to the
desealing of the Petitioner's premises has been allowed, and the
premises of the Petitioner have been ordered to be desealed.
However, the appeal with regard to the Petitioner's challenge to the
rejection of his trade license has been dismissed by the Panchayat's
revision before the trial Court. In this view of the matter, the
reliefs sought in the matter have been worked out considering two
orders passed by the Director of Panchayats.
