- Disposal
- DISPOSED OFF
Holding
The High Court disposed of the writ petitions, holding that the parties' rights will be determined by the final decision of the Supreme Court appeal (Special Leave Petition (C) No. 28560 of 2026).
Summary
Petitioners Vinod Jadhav, Mahesh Patil and Shailaja Thombare filed writ petitions challenging the State of Maharashtra's denial of their right to private practice and the payment of Non‑Practising Allowance to medical officers. The High Court had earlier decided the matter in a common judgment dated 30‑07‑2026 (Writ Petition No. 1583 of 2015 and connected petitions) affirming the State's position. That judgment has been appealed before the Supreme Court in Special Leave Petition (C) No. 28560 of 2026, which the Supreme Court has taken up and continued the interim protection granted by the High Court. The petitioners and the State jointly requested that the pending writ petitions be disposed of, with their rights to be determined by the final outcome of the Supreme Court appeal. The High Court accordingly disposed of the writ petitions, directing that any interim relief continue until the Supreme Court decides the appeal.
