Bombay High Court
KIRAN RAMESH TANWAR AND ANRversusTHE MUMBAI MUNICIPAL CORPORATION THRU COMMISSIONER AND ORS
- Decided
- Disposal
- Disposed Off
Holding
The Court declined to entertain the merits and disposed of the petition, directing the Municipal Corporation to complete the proceedings under the show‑cause notice within three months.
Summary
The petitioners sought a writ of mandamus under Article 226 directing the Mumbai Municipal Corporation (BMC) to act against illegal construction by a third party, alleging that BMC's inaction violated the Mumbai Municipal Corporation Act, 1888. The petition cited multiple complaints and a show‑cause notice issued on 23 May 2025 under Section 351(1A) of the Act. The Court declined to examine the merits, noting that BMC had already taken cognizance by issuing the notice. It ordered BMC to complete the proceedings arising from the notice within three months of the certified copy of the order, subject to hearing all stakeholders. The writ petition was consequently disposed without adjudicating the substantive issues.
Issues considered
- Whether the inaction of the Mumbai Municipal Corporation in addressing the alleged illegal construction is arbitrary, illegal, and contrary to the Mumbai Municipal Corporation Act, 1888, justifying a writ of mandamus.
- Whether the High Court should intervene and direct the Municipal Corporation to proceed with the show‑cause notice issued under Section 351(1A) of the Act.
