HARIBHAU ALIAS HARIDAS ALIAS RANJIT AMBADAS KOKARE (C-505)versusTHE STATE OF MAHARASHTRA AND ANOTHER

Disposal
DISPOSED OFF

Holding

The petitioner is entitled to remission under the Government Resolution for a period of three months.

Summary

The petitioner, Haribha alias Haridas alias Ranjit Ambadas Kokare, filed a criminal writ petition seeking to quash a letter/report dated 27‑11‑2023 issued by the District Judge‑1 and Additional Sessions Judge, Shrirampur, which denied him the benefit of a Government Resolution dated 03‑06‑2017 issued on the occasion of Dr Babasaheb Ambedkar’s 125th birth anniversary. The central issue was whether the petitioner was ineligible for remission under the said resolution. The Court observed that prior judgments held that the nature of the offence should not be a ground for refusing remission and that the petitioner did not fall within any statutory ineligibility. Relying on its earlier decision in Criminal Writ Petition No. 1753 of 2025 and a related matter dated 12‑03‑2026, the Court concluded that the petitioner was entitled to remission for a period of three months. Accordingly, the petition was allowed, the remission was granted, and the petition was disposed.
