Disposal
DISPOSED OFF

Holding

The writ petitions are disposed of, and the parties' rights will be determined by the final decision of the Supreme Court petition, with interim relief remaining in force.

Summary

The Bombay High Court, Bench at Aurangabad, disposed of a series of writ petitions filed by medical officers challenging the entitlement to private practice and the payment of Non‑Practising Allowance, noting that the issue had already been decided in a common judgment dated 30 July 2026 (Writ Petition No. 1583 of 2015). That earlier judgment is presently under challenge before the Supreme Court in Petition for Special Leave to Appeal (C) No. 28560 of 2026, which has been granted notice and interim protection. The Court ordered that the rights of the petitioners in the present writs shall be governed by the final outcome of the Supreme Court appeal. All the writ petitions were therefore disposed of, with any interim relief continuing until the Supreme Court decides the matter.

Issues considered

  • Whether medical officers are entitled to engage in private practice while in government service
  • Whether the Non‑Practising Allowance is payable to medical officers
  • Effect of a pending Supreme Court appeal on the operative status of the High Court's earlier judgment
