Disposal
DISPOSED OFF

Holding

The High Court disposed of the writ petitions, directing that the parties' rights shall be governed by the final decision of the Supreme Court in Petition for Special Leave to Appeal (C) No. 28560 of 2026.

Summary

The Bombay High Court, Aurangabad Bench, disposed of a series of writ petitions filed by several medical officers challenging the entitlement to private practice and the payment of Non‑Practising Allowance, noting that the issue had already been decided in a common judgment dated 30 July 2026 (Writ Petition No. 1583 of 2015 and connected petitions). That earlier judgment is presently under challenge before the Supreme Court in Petition for Special Leave to Appeal (C) No. 28560 of 2026, which has been granted notice and the interim protection previously granted by the High Court has been continued. The petitioners and the State agreed that the present writ petitions should stand disposed, with the rights of the parties to be determined by the final outcome of the Supreme Court appeal. Accordingly, the High Court ordered that any interim relief in the writ petitions remain in force until the Supreme Court disposes of the special leave petition.

Issues considered

  • Whether medical officers are entitled to engage in private practice while in government service
  • Whether the Non‑Practising Allowance is payable to medical officers who do not engage in private practice
  • Effect of the earlier High Court judgment (Writ Petition No. 1583 of 2015) pending a Supreme Court decision

Subjects

  • private practice
