The writ petitions are disposed of, with the parties' rights to be governed by the final outcome of the pending Supreme Court SLP (C) No. 28560 of 2026.
Summary
The Bombay High Court, Aurangabad Bench, disposed of a series of writ petitions filed by medical officers challenging the entitlement to private practice and the payment of Non‑Practising Allowance. The Court noted that the substantive issue had already been decided in a common judgment dated 30 July 2026 in Writ Petition No. 1583 of 2015. That judgment is presently under challenge before the Supreme Court in SLP (C) No. 28560 of 2026, which has been granted notice and interim protection. Accordingly, the Court ordered that the rights of the petitioners in the present writs shall be determined by the final outcome of the Supreme Court SLP. Any interim relief granted earlier will continue until the Supreme Court disposes of the SLP. The writ petitions were therefore dismissed, pending the higher‑court decision.
Issues considered
- Whether medical officers are entitled to engage in private practice while in government service
- Whether the Non‑Practising Allowance is payable to medical officers who do not engage in private practice
- Effect of a pending Supreme Court SLP on the enforceability of the High Court's earlier judgment
Subjects
- private practice
- medical officers
- Non‑Practising Allowance
- writ petition
