MAYANK CO OP. HSG. SOC. LTD AND ANRversusKALYAN DOMBIVLI MUNICIPAL CORPORATION THRU. COMMISSIONER AND ORS

Decided

The Court held that there is no impediment and the municipal corporation may enforce the demolition order, leading to the disposal of the writ petition.

Summary

Mayank Co-operative Housing Society Ltd and another filed a writ petition seeking a mandamus directing Kalyan Dombivli Municipal Corporation to demolish an unauthorized building under a demolition order dated 13 March 2026, issued pursuant to sections 260 and 267(1) of the Maharashtra Municipal Corporation Act, 1949. The petitioners argued that the corporation had failed to act within the 30‑day period prescribed for enforcement. The owner of the building (Respondent No.4) contended that he lacked complete information and requested time to file a reply. The Court observed that the corporation had already taken cognizance, issued the requisite notice, and finalized the proceeding under the cited statutory provisions, and found no legal impediment to enforcement. Consequently, the Court declined to entertain the merits of the petition and disposed of it, allowing the municipal authorities to proceed with demolition.

Issues considered

  • Whether the High Court should issue a writ of mandamus directing the municipal corporation to enforce the demolition order dated 13 March 2026.
  • Whether any legal impediment exists that prevents the municipal corporation from carrying out the demolition under sections 260 and 267(1) of the Maharashtra Municipal Corporation Act, 1949.

instant proceedings.

5. In rejoinder submissions, the learned Counsel for the
Petitioners informed the Court that even though the contesting
Respondent had instituted suit proceedings in respect of the adjoining
plot, it was later on withdrawn. He submits that admittedly qua the

competent Civil Court. He further submits that at present there is no
such impediment not to enforce the order dated 13 th March, 2026 in
accordance with law.

6. Be that as it may. We are not inclined to advert to the
matter on merits. However, we observe that the Municipal
Corporation has already taken cognizance under the provisions of the
Maharashtra Municipal Corporation Act, 1949 (the 1949 Act), the
Notice has already been issued and subsequently the proceeding
has been finalized under Sections 260 and 267(1) of the 1949 Act by
issuing a speaking order. In case there is no other impediment, the
Authorities are at liberty to enforce the order dated 13 th March, 2026,
in accordance with law.

7. With the aforesaid observations, the instant Writ Petition
is Disposed Of.
