USHA KARANSING VALVIversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petitioner's grievance must be addressed by the Grievance Redressal Committee as mandated by the 2024 Government Resolution.

Summary

The petitioner, Usha Karansing Valvi, filed a writ petition before the Bombay High Court seeking relief against the State of Maharashtra and others. The Court examined whether the petition could be entertained directly or should be referred to the Grievance Redressal Committee established under a Government Resolution dated 27 March 2024. It held that the grievance falls within the jurisdiction of the Committee and that the petitioner must first approach it. Accordingly, the Court disposed of the writ petition, granting the petitioner liberty to file her representation with the Committee. The Court also directed the Committee to decide the matter expeditiously, within sixteen weeks of receipt of the order.

Issues considered

  • Whether the High Court can entertain the writ petition directly or must refer the grievance to the Grievance Redressal Committee established under the 2024 Government Resolution
