SAMADHAN SADHU JAGTAPversusTHE STATE OF MAHARASHTRA THR THE SECRETARY AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The Court held that the grievance must be redressed by the Grievance Redressal Committee established under the 2020 Government Resolution.
Summary
The petitioner sought correction of his date of birth in a school record, which was denied by the Education Officer. He filed a writ petition challenging that order. The Court observed that such grievances are to be addressed by the Grievance Redressal Committee constituted under the Government Resolution of 26 February 2020, headed by the Divisional Chairman of the SSC and HSC Board. Accordingly, the Court granted the petitioner liberty to approach the Committee within four weeks and directed the Committee to decide the matter expeditiously. The writ petition was disposed of on that basis.
Issues considered
- Whether the petitioner can compel the Education Officer to correct his date of birth in the school record.
- Whether the order of the Education Officer is amenable to judicial review in a writ petition.
- What is the appropriate forum for redressing the grievance concerning school record correction.
